Terms of Service for Calorimeter AI

1. Acceptance of Terms

By downloading, installing, or using Calorimeter AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Calorimeter AI is a mobile application that uses artificial intelligence to:

• Analyze food photos and provide nutritional information
• Track meals, exercises, and nutrition goals
• Generate personalized nutrition reports
• Provide recipe suggestions with AI-generated images
• Sync data across devices (premium feature)

3. User Accounts

3.1 Account Creation

• You may use the App anonymously or create an account
• Account creation requires a valid email address or third-party authentication (Google/Apple)
• You are responsible for maintaining the confidentiality of your account credentials

3.2 Account Responsibilities

• You must provide accurate information
• You must be at least 13 years old to use the App
• One account per person
• You are responsible for all activities under your account

3.3 Account Termination

• You may delete your account at any time from the App settings
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your data will be deleted within 30 days

4. Subscription and Payments

4.1 Free Version

• Limited features available at no cost
• Subject to usage limitations

4.2 Premium Subscription

• Unlocks additional features (Elite scans, cloud sync, reports, etc.)
• Subscription fees are charged through Apple App Store or Google Play Store
• Prices are displayed in the App and may vary by region

4.3 Billing

• Subscriptions auto-renew unless cancelled 24 hours before the end of the current period
• Refunds are handled according to Apple/Google policies
• No refunds for partial subscription periods

4.4 Cancellation

• Cancel anytime through your App Store/Play Store account settings
• Access continues until the end of the paid period

5. Acceptable Use

You Agree NOT To:

• Use the App for any illegal purpose
• Attempt to reverse engineer or hack the App
• Upload harmful, offensive, or inappropriate content
• Abuse or overload our systems
• Share your account with others
• Use the App to provide medical advice to others
• Scrape or collect data from the App

You Agree To:

• Use the App for personal, non-commercial purposes only
• Provide accurate information
• Respect intellectual property rights
• Follow all applicable laws and regulations

6. Medical Disclaimer

IMPORTANT: Calorimeter AI is NOT a medical device and should NOT be used for medical diagnosis or treatment.

6.1 No Medical Advice

• The App provides nutritional information for educational purposes only
• AI-generated nutritional data may contain errors or inaccuracies
• Always verify nutritional information with official sources
• Consult healthcare professionals for medical advice

6.2 Health Conditions

• If you have medical conditions (diabetes, allergies, eating disorders, etc.), consult your doctor before using the App
• The App is not suitable for managing medical conditions
• Do not rely solely on the App for dietary decisions

6.3 Accuracy Disclaimer

• Nutritional estimates are approximate and may not be 100% accurate
• AI analysis depends on image quality and food recognition
• User-provided data may affect accuracy
• We do not guarantee the accuracy of any nutritional information

7. Intellectual Property

7.1 Our Rights

• The App, including all content, features, and functionality, is owned by us
• Our trademarks, logos, and brand features are protected
• You may not use our intellectual property without permission

7.2 Your Content

• You retain ownership of photos and data you upload
• By using the App, you grant us a license to process your content for providing services
• We do not claim ownership of your personal data

8. Privacy and Data

Your use of the App is subject to our Privacy Policy. We collect and process data as described in the Privacy Policy. You consent to data processing when using the App.

9. Disclaimers and Limitations

9.1 "AS IS" Service

• The App is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• Features may change or be discontinued

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the last 12 months
• We are not liable for third-party actions or content
